1. Acceptance of Terms

By downloading, installing, or using the Fastly mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and ZF Solutions AB (Org. No. 559439-8116), a company registered in Sweden with its registered office at Minkvägen 46, Stockholm, Sweden ("Fastly," "we," "us," or "our").

2. Description of Service

Fastly is a mobile application designed to help users track their intermittent fasting schedules, monitor progress, and achieve their health and wellness goals. The App provides:

  • Fasting timer and tracking
  • Progress analytics and statistics
  • Custom fasting schedules
  • Notifications and reminders
  • Premium features (with subscription)

3. User Accounts

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App.

4. Subscriptions and Payments

4.1 Premium Subscription

Fastly offers premium features through a paid subscription. Subscription details:

  • Subscriptions are billed on a recurring basis (monthly or annually)
  • Payment is processed through the Apple App Store
  • Prices are displayed in the App and may vary by region
  • Subscriptions automatically renew unless canceled

4.2 Free Trial

We may offer a free trial period for premium features. At the end of the trial, you will be automatically charged unless you cancel before the trial ends.

4.3 Cancellation

You can cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.

4.4 Web Purchases and Subscriptions

Subscriptions may be purchased through our website or through the Apple App Store. The refund policy varies depending on the purchase method:

4.5 Refund Policy

For Web-Based Purchases:

We offer a 3-day satisfaction guarantee for all subscriptions purchased through our website. If you are not satisfied with your subscription for any reason, you may request a full refund within 3 days of the initial payment date.

Free Trial Conversions: If you sign up for a free trial through our website and do not cancel before the trial period ends, your trial will automatically convert to a paid subscription. Once converted, you will be charged for the subscription. You may still request a refund within 3 days of the charge date if you are not satisfied.

Important: After the 3-day satisfaction guarantee period expires, all payments are final and non-refundable. We do not offer prorated refunds for partial billing periods.

To request a refund for a web purchase, contact us at hello@fastlyapp.co within 3 days of your purchase with your order details. Refunds will be processed within 5-10 business days to your original payment method.

For Apple App Store Purchases:

Subscriptions purchased through the Apple App Store are subject to Apple's refund policy. We do not have the ability to process refunds for App Store purchases directly.

To request a refund for an App Store purchase:

Apple's decision on refund requests is final and at their sole discretion. Please refer to Apple's Terms of Sale for more information.

4.6 Refund Exclusions

Refunds are not available for:

  • Subscriptions where more than 3 days have elapsed since payment (web purchases)
  • Accounts terminated for violation of these Terms
  • Partial billing periods (no prorated refunds)
  • Renewals of subscriptions that were not canceled before renewal date

4.7 EU Consumer Rights (14-Day Withdrawal Right)

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with EU Consumer Rights Directive 2011/83/EU.

Important Exception: By purchasing a subscription and immediately accessing premium features, you expressly request that we begin providing the service immediately and you acknowledge that you will lose your right to withdraw once you start using the premium features within the 14-day period.

However, our 3-day satisfaction guarantee still applies to all web purchases made by EU consumers, providing additional protection beyond the statutory withdrawal right.

5. Medical Disclaimer

IMPORTANT: Fastly is a wellness and tracking tool ONLY. It is NOT a medical device and does not provide medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare provider before starting any fasting program
  • This app is not suitable for pregnant women, children, or individuals with certain medical conditions
  • If you experience any adverse effects while fasting, stop immediately and consult a doctor
  • We are not responsible for any health consequences resulting from use of the App

6. User Responsibilities

You agree NOT to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Share your account credentials with others
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to transmit harmful code or malware
  • Violate any applicable laws or regulations

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Fastly (ZF Solutions AB) and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of your data as described in the Privacy Policy.

You retain ownership of your fasting data. We will not sell your personal data to third parties.

9. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users or us
  • Exposes us to liability

You may terminate your account at any time by deleting the App and contacting us to delete your data.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App or via email. Your continued use of the App after such changes constitutes acceptance of the new Terms.

12. Apple App Store Terms

12.1 Acknowledgment

If you access the App through the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and FastTrack only, not with Apple, and Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support services for the App
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights
  • You represent that you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you
  • You must comply with applicable third-party terms when using the App

12.2 Subscription Management

For subscriptions purchased through the Apple App Store:

  • Manage your subscription in Settings → [Your Name] → Subscriptions on your iOS device
  • Cancel at least 24 hours before the renewal date to avoid being charged
  • Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • You will be charged for renewal within 24 hours prior to the end of the current period

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

For users within the European Union, you also benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

13.2 Dispute Resolution for EU Residents

If you are a consumer residing in the European Union and you have a dispute with us, you may:

  • Contact us directly at hello@fastlyapp.coto resolve the issue amicably
  • Use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr
  • Lodge a complaint with your local consumer protection authority

13.3 Dispute Resolution for Non-EU Residents

For users outside the European Union, any dispute arising out of or relating to these Terms shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of Sweden.

For U.S. Residents: You may also have the option to pursue binding arbitration through a mutually agreed-upon arbitration service. This does not affect your statutory rights as a consumer.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZF Solutions AB regarding your use of the App and supersede any prior agreements or understandings, whether written or oral.
